Welcome to The Wooden Spoon ("we," "our," or "us"), a cooking and recipe application operated by Aaron Fields in Michigan. These Terms of Use ("Terms") govern your access to and use of The Wooden Spoon mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms.
Please read these Terms carefully before using the App. If you do not agree to these Terms, do not use the App.
You must be at least 13 years of age to use The Wooden Spoon. By using the App, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, outdated, or incomplete.
The Wooden Spoon offers the following auto-renewable subscription plans:
Both plans include a 7-day free trial for new subscribers.
Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
New subscribers may be eligible for a 7-day free trial. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription and your Apple ID account will be charged the applicable subscription fee. Any unused portion of a free trial period will be forfeited when you purchase a subscription.
You can manage or cancel your subscription at any time through your Apple ID account settings. To avoid being charged for a renewal, you must cancel at least 24 hours before the end of the current billing period. Cancellation takes effect at the end of the current paid period.
All subscription payments are processed through Apple. Refund requests must be directed to Apple in accordance with their refund policies. We do not have the ability to issue refunds for App Store purchases.
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
The App and its entire contents, features, and functionality (including but not limited to all recipes, text, images, graphics, logos, icons, and software) are owned by The Wooden Spoon, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
These Terms do not grant you any right, title, or interest in the App or its content. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our content without prior written consent.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Any recipes or cooking information provided through the App are for informational purposes only. We make no guarantees regarding the accuracy, completeness, or suitability of any recipe or nutritional information.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AARON FIELDS, THE WOODEN SPOON, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
We reserve the right to modify these Terms at any time at our sole discretion. If we make material changes, we will notify you by updating the "Last Updated" date at the top of these Terms and, where appropriate, providing additional notice within the App. Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms.
We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Michigan, and you consent to the personal jurisdiction and venue of such courts.
